Domestic workers’ rights: a very important step

When we talk about domestic workers, we must understand that the category has always had enormous economic and social relevance.

This is because, in this category we can include: cleaners, gardeners, nannies, cooks, drivers, security guards, elderly caregivers, among others.

However, although they are very important professions, for a long time the category was plagued by the lack of rights.

As a result, it was very common for professionals not to have a formal employment record, which excluded them from labor rights.

In this way, FGTS, 13th salary, vacations and even minimum wage were issues absent in negotiations between employer and employee.

And, as we well know, when there is no talk of basic day-to-day rights, there is certainly no mention of retirement.

Therefore, for a long period of time, domestic workers did not have access to social security services, which highlights retirement.

But, fortunately, this issue has evolved in our society, and today domestic workers have laws that guarantee their rights.

Among these guarantees, we can highlight the need for registration in certain cases, which guarantees all the rights mentioned above.

And certainly one of the most important rights is retirement, which now has a specific category for the category.

In this case, we are talking about the retirement of domestic workers, or, as we popularly know: retirement of domestic employees.

In the next topics we will learn more about this type of retirement, so don't miss out!

How does domestic worker retirement work?

Talking about retirement is something that always generates interest and curiosity among workers.

This is because it is a fact that the rules change frequently, which affects the possibilities of obtaining this right.

But, just as we have changes that make things difficult, there are also changes and even creations that favor some categories.

One of these creations is certainly the retirement of domestic workers, which offers special conditions for the category.

Therefore, if domestic workers were previously excluded from social security or had difficulty proving their contributions, now everything is different.

To put it simply, domestic worker retirement is part of the retirement category based on length of service.

Therefore, domestic workers must meet the minimum contribution period + minimum age to apply for retirement.

And, when we talk about contribution, we refer to the traditional monthly payments based on salary to the INSS.

It is worth mentioning that this contribution can be made either with a registered employment record or independently.

In the case of registration on the employment record, the worker shares the contribution costs with the employer.

In the case of autonomous contributions, the worker is responsible for the full payment, made through the INSS payment slip.

But, in any case, what we need to know is that domestic workers' retirement is only possible when they have made the contributions required by the INSS.

What are the requirements to obtain this type of retirement?

When it comes to domestic worker retirement, it is very common to hear about the requirements.

But, it is worth saying that much of what is said is not correct.

This is especially true for the belief that only workers with a formal employment contract are entitled to retirement.

This is incorrect information that does not correspond to reality.

This is because, as we have already seen, self-employed domestic workers can also retire.

What changes on this occasion is that instead of the contribution being made through a salary deduction, it must be made by the worker himself.

Therefore, the self-employed worker needs to issue the payment slip INSS collection and make full payment.

In the case of full payment, we use this term, because for workers with a formal employment record, only a percentage is paid by them, since the cost is shared with the employer.

Therefore, it is clear that this requirement for proven employment registration does not exist.

With that clarified, we can finally move on to the basic requirements for domestic worker retirement.

As we have already seen, this category is part of the retirement group based on length of contribution.

Therefore, the requirements basically include the minimum contribution time + age.

    This time is determined by:

Upon reaching the minimum age and period of INSS payments, domestic workers can apply for retirement.

However, it is worth noting that this contribution period does not guarantee the maximum INSS payment, but only 80% of the calculation.

This is because, to receive the full calculation, the worker needs to complete 30 years of contributions for women, and 35 for men.

That said, this request is made to the INSS, and must undergo analysis for approval.

In the next topic we will see a step-by-step guide to requesting your retirement in this category.

How do I apply for a domestic worker's retirement?

Throughout the content we saw all the most relevant information about domestic worker retirement.

With that, we only need to talk about the request to the INSS.

The good news is that this request is not that difficult to make, as it involves the same process as retirement based on general contribution time.

To do this, you can choose 2 different channels: the Meu INSS app, or telephone 135, to schedule an appointment at an INSS organic unit.

In the case of the application, simply access your login using your CPF, then search for "New Request", and finally select the type of retirement you want.

Once this is done, the INSS will request documents and information to assess your case.

After sending everything requested, just wait for the request to be returned in the application itself.

By calling 135, simply call and schedule an appointment for service at an organic unit.

On the scheduled day and time, simply bring the necessary documents, and everything will be sorted out by the attendant.

Whichever method you choose, you will need to wait for the INSS assessment.

If the assessment is positive, the benefit will be granted, and you will be informed about the details of receiving the retirement pension.
